The biological father and mother are natural guardians of their own biological and adopted children until they reach the age of majority.

If one parent dies, the other parent will remain the natural guardian over the child even if this parent remarries.

If the parents divorce the parent who has custody is the natural guardian. In circumstances where both parents are granted joint custody, they both remain the natural guardian over the child. If neither parent receives custody over the child, a guardian over the child may have to be appointed.

A natural guardian of a child can receive, manage, collect or dispose of, and make elections regarding the proceeds of any benefit plan which the minor is a participant, beneficiary, or owner, without appointment, authority, or bond, when the amounts are received do not exceed $15,000.
