FDCPA Mandatory Disclosures

A debt collector is obligated to provide the debtor specific information on the debt, unless the debt is paid within 5 days.  This information is required unless provided in the initial communication from the debt collector: the name and address of the creditor who is owed, the amount of the debt, and that the debtor has 30 days to dispute the debt or it will be assumed to be valid.

If the debtor disputes the debt within 30 days, the debt collector must stop all collection efforts until a written verification of the debt has been provide to the debtor.

The same holds true for a written demand for the name and address of the original creditor within 30 days of the initial contact.
