Under Florida Statute 806.13, Criminal Mischief occurs when the defendant willfully and maliciously injures or damages the property of another.
In Jacksonville, Florida, the amount of damage will determine the penalty for criminal mischief. If the damage to the property is $1,000 or greater, it is a third degree felony. If it is more than $200 but less than $1,000, it is a first degree misdemeanor. Damages under $200 result in a second degree misdemeanor.
