Under Florida Statute Section 893.135(1)(a), Trafficking in Marijuana occurs when the defendant sells, delivers, manufactures, or possesses greater than 25 pounds of marijuana or 300 or more marijuana plants.
In Jacksonville, Florida, trafficking in marijuana carries a minimum mandatory sentence which depends on the amount of marijuana involved. Greater than 25 pounds or 300 plants, but less than 2,000 pounds or 2,000 plants carries a minimum mandatory sentence of three years. Greater than 2,000 pounds or 2,000 plants, but less than 10,000 pounds or 10,000 plants carries a sentence of seven years. If you are in possession of over 10,000 plants or 10,000 pounds, the sentence is 15 years.
